On 18 July 2012 an order was made further extending the deadline for filing the First and Second Defendants’ defence. On 19 July 2012 an order was made extending the deadline for filing the Third Defendant's defence.
On 24 July 2012 an order was made, pursuant to section 16(5) of the Enterprise Act 2002 and rule 48(a) of the Tribunal’s Rules, transferring the claim to the High Court of England and Wales (Chancery Division) with immediate effect.
